Rental Contract Conditions
I. General Terms and Conditions a) Only persons with at least one
year of driving experience may rent and drive a car. Each driver must be
listed in the rental agreement. In the event of unauthorized rental of
the car to another person and damage, the renter is obliged to pay the
full amount of the damage. b) The lessee with whom the agreement was
concluded is also liable for damage caused by other drivers listed in
the agreement. c) Driving to countries outside the Czech Republic is
only permitted for a fee and with the written consent of the lessor -
the amount of the fee is contractual. d) The car is handed over to
the lessee with all operating fluids, mandatory equipment, clean and in
good technical condition. Any comments regarding the rented car must be
made by the lessee at the latest upon taking delivery of the car. e)
Damage to the car body is shown in the "Car Condition Card," which the
renter is familiarized with upon delivery of the car and agrees to with
their signature. f) The rental period ends with the delivery of the
car and car keys to the rental company (i.e., it does not end simply by
parking the car in the event of a breakdown, accident, or other
circumstances). g) The deposit for co-participation in the event of
damage is paid as a security deposit, and the renter agrees that it will
be used to repair damage to the car (including GPS) caused and
attributable to them, in the amount specified in points I - V.
II.
Obligations of the renter a) In the event of any accident or damage
to the car, as well as in the event of a malfunction or suspected
malfunction detected while driving, the driver is obliged to stop the
car, inform the car rental company and follow its instructions.
Otherwise, they expose themselves to the risk of financial participation
as in the case of damage to the car caused by their own fault.
Unless expressly permitted by a car rental company employee, the lessee
is not allowed to repair the car themselves or take the car to a service
center. b) In the event of an accident or theft of the car, the
renter is obliged to report the incident to the car rental company
without delay, call the police competent in the country in which they
are located, and write a report on the incident (request a copy of the
report and hand it over to the lessor). Failure to report the incident
to the police and provide a copy of the police report may result in the
lessee being liable for the entire cost of the damage. c) Accidents
or damage to the car that are not the fault of the lessee are covered
without co-participation if the lessee either: a. calls the police
and obtains a police report stating the identity of the person
responsible and submits it to the lessor b. completes the "Statement
of Liability" form with the person responsible, which is located in the
glove compartment of the car, and submits it to the lessor signed by the
person responsible. d) In the event of an accident and damage caused
by the lessee, or in the event of damage to the car where the identity
of the person responsible is unknown, the lessee shall pay a share of
the damage, up to a maximum of the excess, i.e. up to CZK 15,000. e)
The lessee shall pay for the towing service in the event of an accident
or fault caused by the lessee.II. Lessee f) The lessee shall pay for
damage caused by incorrect gear shifting up to the amount of the
deductible. g) The lessee may not use the car for testing or sporting
purposes, or on unapproved roads. The lessee shall pay for all damage
caused by using the car in a manner contrary to normal use (or under the
influence of intoxicating substances, etc.). h) The lessee is
obliged to use anti-theft devices to protect the car. i) In the case
of long-term rental, the lessee undertakes to bring the car to the
rental company for regular inspection and maintenance within 30 days.
j) The lessee is responsible for refueling with fuel of appropriate
quality and shall keep receipts from fuel pumps in case of later
complaints about fuel quality. In the event of a defect due to refueling
with poor-quality fuel and the absence of a fuel receipt, the penalty is
as specified in II.d). k) The lessee is also responsible for any
damage caused by them that they did not report and that was discovered
after the car was returned. l) The lessee undertakes to comply with
the traffic rules in the given country. In the event of a violation of
regulations and the imposition of a fine by the competent authority for
speeding, illegal parking, etc., the lessee undertakes to pay the car
rental company the full amount of the fine plus any associated fees and
agrees that the car rental company may deduct this amount from their
credit card.f) The Lessee is liable for damage caused by incorrect gear
shifting up to the amount of the participation in damages. III.
Landlord's obligations a) A Czech Republic motorway electronic toll
sticker and car radio are included in the rental price free of charge.
b) Roadside assistance (breakdown service, replacement car, towing) is
included in the rental price free of charge, provided that the lessee
complies with the rental terms and conditions. In the event of an
accident or damage caused by improper use of the car, these services
shall be paid for by the lessee. c) The lessor undertakes to repair
any faults in the car that prevent its use and that were not caused by
the lessee free of charge for the entire duration of the contract (this
does not apply to damage to tires, replacement of light bulbs, burnt
clutch caused by incorrect gear shifting, etc. – such damage shall be
paid for by the lessee). d) In the event of a breakdown that cannot
be repaired on site or an accident, the Lessor shall provide a
replacement car, provided that the obligations under points I. – V. have
not been breached. e) If the requested car cannot be delivered to the
Lessee, the Lessor reserves the right to deliver a comparable car to the
Lessee. f) The lessor is entitled to refuse to rent a car to a person
whose ability or intention to comply with the terms of the contract is
in doubt. h) The lessor reserves the right to withdraw from an
already confirmed order in exceptional cases. IV. Protection of
personal data The lessee agrees that the lessor may make copies of
the documents submitted by the lessee and use them for the purpose of
fulfilling the contract. This personal data will only be provided to
third parties if the Lessor is or will be required to do so by law (data
on the driver of the car at the time of committing an offense or crime
with the car) or for the purposes of resolving a damage or insurance
claim on the car.IV. Personal Data Protection V. Fees a) For
returning an unwashed car, CZK 200. b) For damage to the interior
(upholstery, seats) or heavy soiling (e.g., from a dog), up to CZK
2,000. c) For loss of car documents (ORV – car registration
certificate), the fee is CZK 1,000. d) For loss of car keys, the fee
is up to CZK 7,000. e) The car must be returned with the same amount
of fuel as when it was rented. Otherwise, a refill fee of CZK 300 + the
current price of the missing fuel will be charged. f) In the event of
late payment, the lessee is obliged to pay a contractual penalty of 1%
of the amount due for each day of delay. g) If the lessee returns the car before the return date specified in the contract, the lessee is not entitled to a refund of the remaining rental fee. h) In the
event of theft of the car, the lessee undertakes to pay the lessor a
co-payment in the amount specified in point II.d. i) In the event of
a breach of point I.c), i.e., driving the car to unauthorized countries,
the fee is CZK 5,000 plus other related expenses.V. Charges and
